GENERAL TERMS OF USE

BLUZAT, www.bluzat.com, hereinafter referred to as BLUZAT, is the brand of the company S.C. SOPA PRODUCT S.R.L., organized under Romanian law, with headquarters in BUCHAREST, Emisferei Street, No. 30-34, Building C3, Tel: +4 0741 200 189, registered with the Trade Register under No. J40/7771/2017, fiscal code 37646095, and bank account RO91RNCB0297154645530001 opened in Lei, at BCR. Accessing, visiting, or using the information/content and/or purchasing products presented on the website www.bluzat.com implies acceptance of the Terms and Conditions outlined below. To be informed about all the terms of use of the site, please go through all the sections. BLUZAT reserves the right to make changes and updates to these Terms and Conditions, as well as to the content/structure of the site or the product offer, without prior notice and without specifying the reasons. Please read the Terms and Conditions carefully each time you use this site. Continuing to use the site implies acceptance of the changes made.

1. CONTENT AND QUALITY OF THE SERVICES OF THE WEBSITE

The entire content of the website www.bluzat.com is the intellectual property of S.C. SOPA PRODUCT S.R.L. and is protected by Law no. 8/1996, the law for the protection of copyright and the laws on intellectual and industrial property. BLUZAT guarantees the user limited access, for personal interest (placing online orders, information, contact), on the website www.bluzat.ro. The user is not allowed to copy, transfer, modify and/or alter, use, link to, display, include any content in any context other than that originally intended by BLUZAT and/or for purposes contrary to the interests of BLUZAT, including any content outside the BLUZAT site, removing the signs indicating BLUZAT's copyright on the content, as well as participating in the transfer, sale, distribution of materials made by reproducing, modifying, or displaying the content without the prior written consent of BLUZAT and entails the consequences provided by the current legislation. The BLUZAT site is hosted on the servers of a third-party company. In case of any errors on the site regardless of the reasons for their occurrence, including changes to the site, settings, or updates to programmed scripts, BLUZAT cannot be held responsible. BLUZAT reserves the right to rectify any omissions and errors in display that may occur due to typographical errors or software product errors without prior notice to the user. Also, BLUZAT cannot be held responsible for errors that occur due to the use of certain browsers to visit the website www.bluzat.ro. If a user is given the right by BLUZAT to use, in the form described in a separate user agreement, certain content to which the user gains access through this agreement, this right is subject to the terms and conditions of this document and extends only to that content defined in the agreement, only for the duration of its existence on the site or the period defined in the agreement, according to the conditions defined in the agreement. Any use of the content referred to above for purposes other than those expressly permitted by the document or the accompanying user agreement, if any, or outside the validity period of the agreement, is prohibited. The right to create a web link to www.bluzat.ro is limited, non-exclusive, and revocable and is granted only as long as it does not harm in any way BLUZAT or any of its partners, only after obtaining the written agreement of BLUZAT. BLUZAT is not responsible for the content, quality, or nature of the sites reached through links from the website www.bluzat.ro. For these sites, full responsibility rests with the owners of the respective sites.

2. PRIVACY POLICY AND COOKIES

To make the customer experience on the website www.bluzat.com complete and to enable the dispatch and delivery of placed orders, customers must agree that S.C. SOPA PRODUCT S.R.L. collects and processes the data entered in accordance with the provisions of Law no. 677/2001 and Law no. 506/2004. S.C. SOPA PRODUCT S.R.L. is registered as a personal data operator with the National Authority for the Supervision of Personal Data Processing (www.dataprotection.ro). For more details, please read the Information Note on the protection of personal data. Therefore, BLUZAT guarantees the security and confidentiality of the data hosted and transmitted through its computer system and the use of personal data provided by the customer under the specified conditions. The information transmitted to BLUZAT is used only for the purpose of confirming orders, sending various special offers, promotions, etc., only with the prior consent of the customer. Providing personal data to BLUZAT is not mandatory for users, and they can refuse to provide this data in any circumstances and can request the free deletion of this data from the database. BLUZAT guarantees users the right to request BLUZAT to confirm whether or not their personal data is processed, free of charge, and/or to rectify, update, block or delete, free of charge, the provided data whose processing does not comply with the provisions of Law no. 677/2001 and/or to cease, free of charge, the processing of users' personal data and/or to cease the sending of promotional messages. Any notification for the deletion of users' personal data from the BLUZAT database will be dated, signed, and sent by the person registered in the database, by e-mail to the address office@bluzat.com, or by mail to the address: S.C. SOPA PRODUCT S.R.L., BUCHAREST, Emisferei Street, No. 30-34, Building C3, Romania. BLUZAT undertakes not to disclose personal data to third parties. However, personal data may be transmitted to the authorities in law for checking commercial transactions or other authorities in law for justified checks under the law if requested in accordance with the laws in force. The website www.bluzat.ro uses cookies to streamline users' access to the site. By continuing to browse, the user expresses their agreement to the use of cookies. BLUZAT guarantees that it will comply with the requirements of Law no. 677/2001 regarding the protection of individuals with regard to the processing of personal data and the free movement of such data, as amended and supplemented, and Law no. 506/2004 on the processing of personal data and the protection of private life in the electronic communications sector, Law no. 365/2002 on electronic commerce, as well as Ordinance no. 130/2000 on the protection of consumers in the conclusion and execution of distance contracts, with subsequent amendments. BLUZAT cannot be held responsible for errors that occur due to the user's negligence regarding the security and confidentiality of their account and password. BLUZAT cannot be held responsible in any way for the loss or alteration of personal data stored on the BLUZAT website for the purpose specified in this document.

3. PRODUCTS OFFERED BY BLUZAT

The products sold through www.bluzat.com are new, in BLUZAT packaging, and at the time of delivery, they are accompanied by the fiscal invoice, in accordance with the current legislation. The prices displayed include legal taxes and do not include delivery charges unless explicitly stated on the site. The purchase price printed on the invoice will be the same as that set by the BLUZAT consultant together with the customer at the time of order confirmation. BLUZAT products are offered in accordance with the Terms and Conditions outlined in this document and within the limits of available stock. For this reason, BLUZAT assumes the right not to honor an order if the respective product is no longer found in the current BLUZAT offer. In case of software errors and the existence of incorrect prices displayed on the site, the final price is always considered to be the one accepted by the customer in the discussions with the BLUZAT consultant. If the actual price of the product is higher than the price displayed on the site, our consultant is obliged to fulfill the request to deliver the product to the customer at the price published on the site, only to the extent that BLUZAT can do so and the customer does not refuse the order. If the actual price is lower than the price published on the site, and the customer has paid the price in advance, the difference will be returned as agreed between the customer and the BLUZAT consultant, but no later than 30 days from the date of receiving the product. The images published on the site are for example only, and the delivered products may have slight differences from the presented images, in terms of appearance, color, accessories, and other features. The content of BLUZAT (texts, product descriptions, technical features, images, symbols) is composed in accordance with the information taken from raw material suppliers. For this reason, BLUZAT does not assume responsibility for the descriptions and specifications of the products displayed on the website www.bluzat.ro. BLUZAT reserves the right to modify the technical specifications of the products without prior notice. BLUZAT does not offer any warranty, expressly or implied, regarding, but not limited to, the operation of this site, the information, the accuracy of the descriptions, the updating of the content, the products on the site, as well as their suitability for a particular purpose. Users expressly agree that the use of this site and the purchase of related products or services are at their own risk, the only exception being BLUZAT's obligation to grant users the right of unilateral termination of the contract according to current legislation, as detailed below in this document.

4. VALIDITY OF OFFERS

BLUZAT reserves the right to modify the prices charged for products available on the site without prior notice to users. The purchase price of a product is the one at the time of placing an order by the user, within the limits of available stock. In the case of promotional offers, the purchase price of the product is the one at the time of placing the order, within the limits of available stock and/or the promotional period, if defined. The purchase price of a product cannot be modified at a later time than the issuance of an order, except with the agreement of the user and BLUZAT only if the order has not been shipped to the customer. The renunciation of a product purchased through an online order can only be made during the period between placing the order and delivering the product to the customer. The renunciation of a product purchased and delivered to the customer's address by BLUZAT can be made in accordance with the provisions of the Product Return section.

5. ONLINE ORDER POLICY

Any user has the possibility to purchase BLUZAT products only if they have or create an account on the website www.bluzat.com. By creating an account, the user agrees to the specified Terms and Conditions. BLUZAT reserves the right to temporarily suspend a user's access or block their account in case of non-compliance with the provisions of the document. By completing the order, the customer confirms that all necessary data for the purchase process provided by them are correct, complete, and true at the time of placing the order. By completing the order, the Customer agrees that BLUZAT can contact them, through any available means for both the customer and BLUZAT, for validation: availability of products and quantities purchased by the customer, the value of the order placed, and including, depending on the situation, other value-added services (transport) as well as details of product delivery. The order processing schedule is from Monday to Friday between 09:00 - 16:30, and delivery will take place from Monday to Friday between 09:00 - 18:00, and if the customer requests and is possible, on Saturday between 09:00 - 14:00. BLUZAT can automatically cancel the order placed by the customer, without any subsequent obligation of either party to the other or without either party being able to claim damages, in case the data provided by the user on the site is incomplete or incorrect or it is found that the user's activity on the site does not comply with the Terms and Conditions provided in this document. The customer can cancel a placed order when contacted by BLUZAT for validation. From the moment the customer validates the value of the order placed or when BLUZAT informs the customer about their validated order, the customer's order becomes a Distance Contract, thus applying the definitions contained in O.G. 130/2000 art. 2, to which these Terms and Conditions are attached, but not limited to. All existing customer orders in progress at a given time retain the data defined by the customer before the modification, even if they change their personal data in the meantime, using the section available in the user's account. The details of product delivery, including but not limited to delivery time, do not constitute a contractual obligation on the part of BLUZAT, without either party being able to claim damages if either party is or is prejudiced in any way by the violation of these. Any customer with a voucher can use only one voucher within an online order. The use of multiple vouchers will result in the cancellation of the order by BLUZAT representatives.

In case you have been contacted by phone to confirm the order and have not received an affirmative response or have not been contacted following the missed call, we reserve the right to cancel the order.

6. PAYMENT OF PRODUCTS

The delivery of a product will be made only if the product is fully paid by the customer through the means of payment chosen by them when placing the order. Otherwise, delivery will not be made. Payment for products ordered from the website www.bluzat.com can be made in advance or upon delivery of the products (cash on delivery). BLUZAT reserves the right, in certain cases, to request advance payment for products. Advance payment can be made by bank transfer or card payment, and proof of payment must be sent to BLUZAT at the email address office@bluzat.com. Delivery will be made only after the money enters the BLUZAT account.

7. TRANSPORT AND DELIVERY OF PRODUCTS

The delivery of products will be made to any locality in Romania. BLUZAT reserves the right to contact the customer to confirm the order before shipping the package. Delivery will be made by Express Courier (GLS): within up to 10 working days* (*depending on product availability). Delivery costs for localities in Romania where GLS delivers.

• FREE for orders exceeding 300 Lei
• 20 Lei for orders with a value less than 300 Lei If the customer is not found at the address specified by them in the form on the site, during the agreed-upon time interval, they will be contacted by phone by the courier. The courier will return once they manage to contact the customer. If, under these conditions, the customer is not found at the specified address, the order will be canceled due to refusal, and the product will be returned to the BLUZAT headquarters. The customer will be notified by email of the order cancellation. Following a refused shipment, future orders will be paid in advance by that customer. The invoice constitutes a sales contract under Romanian law. Signing the courier's documents represents the customer's acceptance that the products have arrived in good condition. BLUZAT reserves the right to delay or cancel deliveries of ordered products if they cannot be fulfilled due to reasons beyond BLUZAT's control, including snow, fires, explosions, floods, strikes, government actions, or other force majeure events under Romanian law. The maximum value of damages that can be paid by BLUZAT to any customer in the case of non-delivery or improper delivery is the value of the sum collected by BLUZAT from that customer.

The non-pickup/refusal of ordered packages or repeated returns will be considered abuse, and our company reserves the right to refuse future orders placed by the customer.

8. WARRANTY OF PRODUCTS

The warranty conditions are in accordance with Law 449/2003 and O.G. 21/1992. At the request of the warranty, it is necessary to present the defective product in its original packaging, together with the accessories, a copy of the invoice, and the original warranty certificate. If the products are sent and arrive in conditions other than those specified above and/or without these documents, BLUZAT reserves the right to return the products to the applicant without resolving the warranty.
